These Terms and Conditions (“Terms”) govern your access to and use of the website https://untoldradioam.com/ (the “Site”), and all related content, streaming services, subscriptions, products, and services offered thereon, which are owned and operated by Metro Moulded Parts, Inc. d/b/a Untold Radio Network (“Company,” “we,” “us,” or “our”).

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING, BROWSING, OR USING THIS SITE, OR BY PURCHASING A SUBSCRIPTION OR PRODUCT FROM US, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE MANDATORY ARBITRATION AND CLASS ACTION WAIVER PROVISIONS DESCRIBED IN THE “DISPUTE RESOLUTION” SECTION BELOW. We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

The Untold Radio Network name and logo are trademarks of the Company. You are granted a limited, non-exclusive, revocable license to access the Content for your personal, non-commercial use only.

3. USER ACCOUNTS AND SUBSCRIPTIONS

To access certain features, you may be required to create an account or purchase a subscription. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account. We reserve the right to refuse service, terminate accounts or subscriptions, remove or edit content, or cancel orders in our sole discretion.

4. TERMS OF SALE AND SUBSCRIPTIONS

  • Subscriptions and Purchases: We may offer subscriptions, one-time purchases, or other services. All purchases are subject to our acceptance. We reserve the right to refuse or cancel any order or subscription for any reason.
  • Payment and Billing: All prices are shown in U.S. dollars. We accept payment via PayPal, Braintree, and Shopify/BigCommerce payment processing. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method. For subscriptions, you authorize us to charge your payment method on a recurring basis (e.g., monthly, annually) until you cancel your subscription in accordance with the cancellation procedures.
  • Refund Policy: Due to the nature of digital content and streaming services, all purchases and subscription fees are non-refundable. We do not provide refunds or credits for any partial subscription periods or unused services. If a product or service is not as described, your sole remedy may be a replacement or credit at our sole discretion.

5. CONTENT AND SERVICE DESCRIPTIONS

We attempt to be as accurate as possible in the descriptions of our content, services, and products. However, we do not warrant that the descriptions or other Content of this Site are accurate, complete, reliable, current, or error-free. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THIS SITE, ITS SERVERS, OR EMAIL SENT FROM US ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, METRO MOULDED PARTS, INC. WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES PURCHASED EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Metro Moulded Parts, Inc. d/b/a Untold Radio Network, its officers, directors, employees, agents, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account by you or any other person.

10. DISPUTE RESOLUTION: MANDATORY ARBITRATION AND CLASS ACTION WAIVER

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.
  • Binding Arbitration: YOU AND THE COMPANY AGREE TO WAIVE YOUR RIGHTS TO A JURY TRIAL AND TO HAVE ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS RESOLVED IN COURT. Instead, all disputes will be resolved through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will be conducted by a single, neutral arbitrator and will take place in Anoka County, Minnesota.
  • Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. TO THE FULL EXTENT PERMITTED BY LAW, (I) NO ARBITRATION OR PROCEEDING SHALL BE JOINED WITH ANY OTHER; (II) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS; AND (III) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR ANY OTHER PERSONS.
  • Exceptions: Notwithstanding the foregoing, either party may bring a lawsuit in court solely for injunctive relief to stop unauthorized use or abuse of the Site or intellectual property infringement.

11. GENERAL PROVISIONS

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and the Company and govern your use of the Site.
  • Severability: If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
  • Waiver: Our failure to enforce any part of these Terms is not a waiver of our right to later enforce that or any other part of these Terms.
